Our services include the following:

1. FAMILY LAW MATTERS

Historically, family law matters such as separation, divorce, custody, access and maintenance have been acrimonious and very often unnecessarily litigious. The courts do not favour this and there is a leaning towards settlement and problem solving via mediation and facilitation. Mediation and facilitation even extends to post divorce matters that may arise. Our Director is a trained mediator and favours this only where the parties are in agreement to mediation. Where mediation would not be the most practical in any given situation, we litigate and negotiate in a professional manner.

2.GENERAL LITIGATION

This covers a variety of situations, including motor vehicle accidents, contractual disputes, neighbour law, and all matters where agreement with the other party cannot be reached

3.WILLS AND ESTATES

We discourage persons to have their will done by the financial institutions for various reasons, one of which is that they sometimes lack the legal skills to enter into litigation situations where this is needed. We believe in personal attention at the very outset, which is at the drafting of the will and explaining all possible options and consequences.

4.DEBT MANAGEMENT

In today’s economic times, it is no longer considered an embarrassment to find oneself over-indebted. Debt has an effect on the quality of life, on one’s peace of mind, and a major stress factor which can cause serious side effects to you and to your family. Our director is a registered Debt Counsellor and our services include debt review (a.k.a debt counselling) and debt management which includes legal representation vis-à-vis your creditors.

5.DRAFTING OF CONTRACTS

It is not only large companies and corporations that require contracts. Whilst a verbal contract is also binding, it is often difficult to prove the contents of that agreement where there is any dispute. Contracts can range from a simple one page agreement, to an intricate and voluminous one. We believe in keeping our wording as simple as possible in order to avoid any uncertainties and so that the ordinary “layperson” can understand what is being agreed upon.

6.CREDIT LAW

The National Credit Act, 34 of 2005, is a vast Act that is still being tried and tested by our courts. Credit law also overlaps with Consumer Protection and almost every transaction in the retail and commercial fields have to be tested against the standards set by the National Credit Act and the Consumer Protection Act 68 of 2008. Our services include the investigation and challenging of reckless lending practises, investigating the charging of prohibited fees and costs by credit providers, misrepresentation and fraudulent conduct by individuals and corporations, and generally coming up against unscrupulous practices in the industry.

7.BUSINESS RESCUE AND TURNAROUND

Business rescue is a formal process and can be a costly procedure, depending on the complexity and size of the business and the form of rescue required. It is also often a futile procedure if the company attempts such a process too late. We mostly attend to informal business turnaround for the small to medium business, which entails an assessment of management practises and advice, as well as a structured payment plan for creditors.
